A woman in her thirties has been sentenced to a prison term following false rape allegations against her biological father, who financially supported her overseas education yet declined her monetary requests.
Recent information from the legal sector reveals that the Namyangju Branch of the Uijeongbu District Court's Criminal Division 1, under the jurisdiction of Presiding Judge Choi Chi-bong, has sentenced a woman in her 30s, referred to as A, to ten months of imprisonment on charges including defamation, obstruction of business, and insult.

The defendant, A, faced trial for disseminating defamatory content in 11 separate postings on an online forum from May to June of the previous year. These posts were titled "I am a victim of familial sexual violence. Please look at this," falsely implicating her father, B, in sexual misconduct.
In these public statements, A alleged, "Since the age of four, I have been subjected to continuous sexual assault by my biological father, and my mother has also endured domestic and sexual abuse," further claiming that a settlement of 30 million won was reached and demanded stringent punitive measures.
A also revealed B’s full name and business details, reportedly impairing the operations of his business.
Further accusations by A included six posts alleging that B had remarried a woman, C, with whom he was purportedly having an affair.

In February 2021, A initiated a legal claim for damages due to alleged sexual assault against B in the Incheon District Court but was unable to substantiate her claims with evidence of any unlawful behavior.
During the criminal proceedings, A maintained the veracity of her allegations, but the court dismissed her assertions, referencing the outcome of her prior lawsuit. The court noted the absence of concrete evidence or circumstances supporting A's claims of habitual sexual assault by B.
The court considered A's accusations as likely false, highlighting that B had financially supported A’s international education and continued to do so upon her return. The court also noted that the rape allegations coincided with B’s refusal to finance A’s business venture proposal for a cafe.

Addressing the case, the court stressed, "The dissemination of false information arose from dissatisfaction over denied financial aid. The reputational damage inflicted on the victims remains irreparable."
The court elaborated on the rationale for sentencing, stating that A posed a significant risk of reoffending, as evidenced by her continued similar postings post-offense, along with the victims' strong demand for stringent punitive action against her, all influencing the court's decision comprehensively.
